2.- Conditions for the use of the Website

2.1.- Content

Access to the Website is free of charge and the users undertake to make proper use of the same, as well as of all its contents, in accordance with the Law and the present Legal Notice.

In this respect, they shall be liable to Moncada Legal or to third parties for any damages which may be caused as a consequence of the breach of the aforementioned obligation.

By way of example only, in accordance with the legislation in force, the user shall refrain from:

• Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the contents, except in cases authorised by law or expressly consented to by Moncada Legal, or by whoever holds the ownership of the exploitation rights, as the case may be.
• Reproduce or copy for private use, or for the use of third parties, the contents which may be considered as software or database, in accordance with the legislation in force on intellectual property.
• Extract and/or reuse all or part of the contents of the Website as well as of the databases made available to users by Moncada Legal.

The contents of the Website are for information purposes only. The information included does not constitute, under any circumstances, a source of advice, nor does it establish a professional relationship, or any other type of relationship, between the user and Moncada Legal.

Its use is the sole responsibility of the user, and therefore it is not advisable to make decisions based on the information provided without the appropriate individualised professional advice.

All information provided by the user, through the forms on the Website, must be truthful, and the user shall be solely liable for any false or inaccurate statements made and for any damages caused thereby to Moncada Legal or to third parties.

2.2.- Website Links

2.2.1.- Links to the Website

Any Internet users wishing to insert links to the Website shall request prior authorisation from Moncada Legal.

In any case, such links shall be authorised under the following conditions:

• They must be directed to the home page of the Website, without reproducing it in any form whatsoever.
• The creation of frames of any kind which surround the Website or allow the contents of the same to be viewed through Internet addresses other than those of the Website, in such a way as to:
  • • Induces error, confusion or deception regarding the origin of the content.
    • Involves unfair conduct
    • Uses or damages in any way the reputation and image of the firm and its brand.
• The use of any word, graphic or mixed brand or any other distinctive sign of Moncada Legal, without the express authorisation of its owner, is prohibited.
• No false, inaccurate or incorrect statement of any kind may be made from the page which introduces the link regarding Moncada Legal, its partners, employees, clients or collaborators, or regarding the quality of the services it provides.
• Under no circumstances shall it be stated, on the page where the link is located, that Moncada Legal has given its consent to the insertion of the link or that it otherwise sponsors, collaborates, verifies or supervises services other than those expressly provided by Moncada Legal.
• The website to which the link is inserted shall comply with the applicable law.

The existence of this type of link in no way implies the existence of a relationship between Moncada Legal and the owner of the website in which the link to the Website is included, nor the acceptance or approval of its contents or services.

In any case, Moncada Legal reserves the right to prohibit the use of previously authorised links at any time, inter alia, in the event of unlawful activity or content of the website to which the link is included.

2.2.2.- Links on the Website

Moncada Legal may include links on the Website which allow users to access the websites of third parties, in order to facilitate their browsing experience.

In such cases, Moncada Legal acts as a provider of intermediary services, in accordance with Article 17 of Act 34/2002, of 11th July, on information society services and electronic commerce, and shall only be liable for the contents and services provided in the links, to the extent that it has actual knowledge of the unlawfulness and has not deactivated the link with due diligence.

In the event that the Users should consider that there is a link with unlawful, harmful, denigrating, violent or inappropriate content, they shall notify Moncada Legal, by e-mail to info@moncada.legal, indicating the following points:

• Personal data of the communicating person: name, address, telephone number and e-mail address.
• Description of the facts that reveal the unlawful or inappropriate nature of the link.
• In the case of infringement of rights, such as intellectual and industrial property rights, the personal data of the person who is the owner of the infringed right, if different from the communicating person.
• Statement that the information contained in the complaint is accurate.

The receipt by Moncada Legal of the communication provided for in this clause shall not imply actual knowledge of the activities and/or contents indicated by the communicating person.

Under no circumstances shall the existence of links presuppose the corresponding existence of agreements with the persons responsible for or owners thereof, nor the recommendation, promotion or identification of Moncada Legal with the statements, contents or services provided therein.

Moncada Legal shall not be held liable for the content or services offered therein, nor for any damages which may arise as a result of their consultation, contracting or use.
